Deaton v. Trans Union LLC

A settlement has been proposed in a class action lawsuit pending in the United States District Court for the Eastern District of Pennsylvania, entitled Deaton v. Trans Union, LLC, No. 2:20-cv-01380.

Members of the proposed Settlement Class are those individuals who, between March 20, 2018 and October 21, 2020, (i) disputed information related to a United Student Aid Funds student loan contained within their credit report from TransUnion; (ii) TransUnion responded by identifying “United Student Aid Funds c/o Sallie Mae” as the furnisher of information about the student loan; (iii) where Navient was the furnisher; and (iv) the record of the student loan remained on their TransUnion credit report after the dispute are members of a Class Action.

The Notice explains the nature of the lawsuit, the general terms of the proposed settlement and your legal rights and obligations as a member of the Settlement Class.

Directly as a result of the lawsuit, and as a condition of the Settlement, TransUnion has made changes to its procedures for identifying the furnisher of United Student Aid Funds student loans and for providing consumers with all of the disclosures required by the FCRA after it conducts a reinvestigation into disputed information.

Further, TransUnion has agreed to offer each Settlement Class Member a free eighteen (18) month Credit Monitoring Subscription, which includes unlimited online access to TransUnion credit reports and scores, valued at nearly $180 per person. Eligible Class Members do not need to do anything to receive an Access Code for a Credit Monitoring Subscription in connection with the settlement.

Important Dates and Deadlines
Exclusion Deadline The deadline to exclude yourself from the lawsuit and Settlement is December 3, 2021.
Objection Deadline The deadline to object to some or all of this Settlement is December 3, 2021.

Approval Hearing
The Final Settlement Approval Hearing will be held on February 22, 2022 March 23, 2022 at 10:30 a.m. before Honorable Anita B. Brody in the U.S. District Court for the Eastern District of Pennsylvania, located at 601 Market Street, Philadelphia PA 19106, Courtroom 7B.
